Terms of Service

These Terms govern your use of Darkmen ("the Service"). By creating an account, subscribing, or otherwise using the Service, you agree to all of the following. If you do not agree, do not use the Service.
1. The Service is informational only
Darkmen aggregates and delivers crypto-related signals, alerts, and dashboards from public market data. The Service is provided for informational and educational purposes only.
Nothing on the Service is investment, financial, tax, legal, or accounting advice. A full description of what the Service is not, and the risks you accept by using it, is in the Risk Disclaimer. The Disclaimer is part of these Terms by reference and you must accept both at checkout.
2. Eligibility
You may use the Service only if you (a) are at least 18 years old, (b) have legal capacity to form a binding contract under the law of your jurisdiction, and (c) are not subject to comprehensive sanctions by the US (OFAC), EU, UK, or UN. By using the Service you represent these facts are true.
3. Accounts
- You are responsible for maintaining the security of your credentials and any linked identities (Telegram, Discord, OAuth providers).
- You must provide accurate information at registration and keep it up to date.
- One person — one account. You may not share access to your account.
4. Billing and access terms
- Paid tiers (Basic, Pro) are sold as fixed-term access (currently 30 days). They do not renew automatically — access lapses at the end of the paid term unless you purchase again.
- Prices and tier features are described on the Pricing page and may change with notice; price changes apply only to purchases made after the change takes effect.
- Payments are processed by NOWPayments (cryptocurrency, e.g. USDT) and Telegram Stars (in-app, through Telegram). We do not accept, process, or store payment-card details.
- You are responsible for any taxes applicable to your purchase. We do not collect or remit VAT or other taxes on your behalf.
5. Refunds
All payments are non-refundable. When you check the agreement box at checkout you give explicit consent that performance begins immediately and (under EU/UK law) waive your right of withdrawal. Full text and US-jurisdiction grounding are in the Refund Policy, which is part of these Terms by reference.
6. Cancellation
Because paid access is a one-time purchase for a fixed term with no automatic renewal, there are no recurring charges to cancel. Your access simply ends when the paid term expires unless you choose to buy another term. You may stop using the Service at any time.
7. Acceptable use
You agree not to:
- Use the Service to violate any law, sanctions regime, or third-party right.
- Reverse-engineer, scrape, redistribute, resell, or commercially exploit the signals or any other content of the Service.
- Use the Service to provide regulated investment, advisory, brokerage, or money-transmission services to third parties.
- Interfere with the Service's operation or attempt to gain unauthorised access to any part of it.
We may suspend or terminate accounts that violate this section, with or without notice.
8. Limitation of liability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the fullest extent permitted by law, Darkmen is not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to loss of profits, data, opportunity, or trading losses — arising from your use of or inability to use the Service. The detailed limitation, including a damages cap, is set out in section 6 of the Risk Disclaimer.
Trading cryptocurrency carries substantial risk and you may lose your entire investment. Past performance is not indicative of future results.
9. Intellectual property
All content of the Service — including signal definitions, dashboard design, source code, copy, trademarks, and aggregated data presentations — belongs to Darkmen or its licensors. You may use the Service only as these Terms allow.
10. Changes to the Service or these Terms
We may add, change, suspend, or discontinue any feature at any time. We may update these Terms; material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the new Terms.
11. Termination
You may close your account anytime. We may terminate accounts for breach of these Terms, fraud, chargeback abuse, or sanctions exposure. On termination, sections 5 (Refunds), 8 (Limitation of liability), 9 (Intellectual property), 12 (Governing law), and 13 (Record of consent) survive.

Each subscription purchase is recorded with the version of these Terms accepted, the timestamp of acceptance, and the IP address of the accepting party. The record is retained for the duration required by financial-records law and is admissible evidence of your agreement.
14. Severability
If any provision of these Terms is held unenforceable, the remainder remains in full force.
